§ 22-223. Vehicle for hire decal.

  • (a)

    Decal required. It shall be unlawful to operate any vehicle for hire upon the streets of the city without a valid and current vehicle for hire decal issued by the city for that specific vehicle. A vehicle for hire decal may be applied for on a city form upon compliance with the requirements of this article and payment of a decal fee. No decal issued pursuant to this section shall be deemed the property of the holder thereof.

    (b)

    Display of decal. Every vehicle for hire decal issued by the city shall be immediately affixed to the vehicle utilizing the adhesive provided on the decal. Such decal shall be affixed to the upper center of the rear windshield and shall be clearly visible. Once affixed, a vehicle for hire decal shall not be removed except as provided in this section. Any decal that is not properly affixed to the vehicle may immediately seized by the city. Any operation of a vehicle for hire in the city without a decal shall be strictly prohibited.

    (c)

    Non-transferability of decal. Each vehicle operated as a vehicle for hire must have its own separate decal. Each decal shall remain dedicated to the vehicle specified in the application. No vehicle for hire decal issued shall be in any manner duplicated, assigned, sold or otherwise transferred. Any decal that is transferred, assigned, or otherwise conveyed or stolen shall be automatically revoked.

    (d)

    Term of decal. The required fee, with accompanying application, shall be due and payable on or before September 30 of each year. Decals shall expire on September 30 of each succeeding year. If September 30 is on a weekend or holiday, the fee shall be due and payable on or before the first working day following September 30.

    (e)

    Renewal of decal. A vehicle for hire decal issued pursuant to this section may be renewed upon payment of a renewal fee and continued compliance with the requirements of this article. The operation of a vehicle without a valid and current decal shall constitute a violation of this section. If any of the information required in the application changes prior to any subsequent annual renewal date, the vehicle for hire company or driver shall provide the City updated information within 30 days of such change. In the event of a change of ownership or premises location, a new application and fee shall be required.

    (f)

    Replacement of decal. In the event that a vehicle for hire sustains windshield damage beyond repair or if a vehicle is destroyed or sold, the decal shall be removed from the vehicle and surrendered to the city within 14 days of the date of the occurrence. A replacement decal shall be issued upon surrender of the decal, payment of a replacement fee, and continued compliance with the requirements of this article. In the event that a decal is stolen or damaged beyond recognition, evidence of such theft or damage shall be provided to the city in the form of a police report.

    (g)

    Surrender of decal. Every vehicle for hire company shall remove and surrender to the city all decals issued for vehicles that are no longer operating for that vehicle for hire company within ten days of the vehicle's removal from service.

    (h)

    Payment of outstanding debt to city. No vehicle for hire company or driver may be issued a vehicle for hire decal until all outstanding uniform code citations, outstanding parking citations, civil penalties and applicable fees have been paid.
