§ 94-134. Affordable housing incentive program.
(a)
Intent. The intent of the affordable housing incentive program is to promote the creation of affordable housing by allowing additional development capacity for projects which include affordable housing units.
(b)
Applicable area. The affordable housing incentive program shall apply to qualified properties in the DMP area which meet the affordable housing incentive requirements.
(c)
Affordable housing incentive requirements. The city may allow an increase in development capacity for a proposed development which meets each of the following requirements:
(1)
The proposed development shall comply with all the receiving site requirements in subsection 94-132(e).
(2)
The proposed development shall comply with all the subdistrict requirements and shall not exceed the maximum FAR and height allowed by Figure IV-35 and the corresponding building requirements table.
(3)
The proposed development shall obtain city commission authorization for the conveyance of city-owned development rights as a requirement of site plan approval. If the site plan approval expires prior to commencement of construction, the development rights transferred by the city at no cost are forfeited and revert back to the city.
(4)
The city's TDRs shall be dedicated to residential uses only.
(5)
Additional development capacity for other uses may be purchased through the TDR program as long as the total gross building area does not exceed the maximum FAR and height allowed by Figure IV-35 and the corresponding building requirements table.
(6)
Affordable housing units provided shall meet all requirements and controls set forth in this section.
(d)
Affordable housing incentive calculation. The additional development capacity is based on a ratio, and shall be calculated as follows:

121%—150%1 1 2 The affordable housing incentive calculation is based on a net interior area, and does not account for circulation and common areas.
(e)
Affordable housing unit requirements. Affordable housing units created through this incentive shall meet the following requirements:
(1)
The classification of the family income, the maximum price of the affordable housing unit, and the maximum rent charged shall be based upon the city's most recent version of the purchase affordability table as administered by the housing and community development department.
(2)
Affordable housing unit shall be finished completely, including elements such as, but not limited to, appliances, finished floors, doors, light fixtures, and any other elements consider standard for a market-rate finished unit within the same building.
(3)
Affordable housing units shall not be clustered or segregated from market-rate units.
(4)
Unit mix of affordable housing units in proposed development shall match the unit mix of the market-rate units in proposed development.
(5)
Required parking spaces for affordable housing units may be reduced by ten percent.
(f)
Affordability controls. All developments seeking to utilize the affordable housing incentive shall enter into an affordable housing development agreement with the city, on city approved forms which include the following conditions:
(1)
The affordable housing development agreement shall be signed before a building permit can be issued.
(2)
Affordable housing units shall be sold or rented only to qualified buyers approved by the housing and community development department, and according to the most current purchase affordability table administered by the housing and community development department.
(3)
The affordable housing units shall be restricted to residency by qualified buyers or renters for a period of ten years from the date of the issuance of the certificate of occupancy for such unit.
(4)
Developments that are administered by federal, state, or local housing agencies shall be exempt from the affordability controls. However, proposed developments shall demonstrate that affordable units are being created to all other applicable standards as provided in this Code.
