§ 90-54. Limited use of water supply area authorized as exception to section 90-51.

  • (a)

    As an exception to the trespassing prohibitions of section 90-51, the public shall be permitted to enter upon the waters of Lake Mangonia during daylight hours for the purposes of fishing and boating as provided in this section. The term "daylight hours" shall mean that part of the day between 30 minutes after sunrise and ending 30 minutes before sunset.

    (b)

    No motor-powered boat or motorboat, seaplane, airboat, amphibious automobile or other such similar motor vehicle powered by any form of internal-combustion engine shall be used or permitted upon the waters of Lake Mangonia except:

    (1)

    Boats powered solely by electrical power;

    (2)

    Manually propelled boats such as those boats known as Man-U-Troll Aquafin, and the like.

    (c)

    The limitations set forth in this section shall not apply to law enforcement officers, or officials, employees or agents of governmental agencies, in the performance of their work duties.

    (d)

    It shall be unlawful for any person to put a boat into the waters of Lake Mangonia, or to withdraw a boat therefrom, at any place not designated for such activity by the public. This prohibition shall not apply, however, to persons owning property abutting lands surrounding Lake Mangonia using their own property for such purpose.

    (e)

    It shall be unlawful for any person to fish in the waters of Lake Mangonia except from a boat, or from land where fishing is posted as an authorized recreational activity.
