§ 90-51. Trespassing; water withdrawal permits.

  • (a)

    It shall be unlawful for any person to enter upon any portion of the water supply area of this city as defined in this subsection, except in those areas where posted signs identify areas for public use and access. As used in this chapter, the term "water supply area" means the waters of Clear Lake, Lake Mangonia, the water catchment area, now called "Grassy Waters Preserve" and all canals connecting such bodies of water.

    (b)

    The prohibition provided in subsection (a) of this section shall not apply to law enforcement officers, or to officials, employees or agents of governmental agencies, in the performance of their work duties.

    (c)

    It shall be unlawful for any person to withdraw water from the water supply area of this city without first receiving a special permit therefor to be issued in the discretion of the public utilities director. Water withdrawal permits shall be issued upon such terms and conditions as shall be prescribed from time to time by resolution of the city commission.
