§ 90-1. Water service and sewer service provided to public by city.

  • (a)

    The providing of water from the water supply system of the city to the public, as authorized by law, shall be referred to in this chapter as the "water service." The collection of sewage and its disposal by the city from the public, as authorized by law, shall be referred to in this chapter as the "sewer service." The city may, in the discretion of the city commission, extend either or both of these services into areas outside the municipal boundaries of the city upon such terms and conditions as the city commission may prescribe.

    (b)

    The city shall own the facilities necessary to provide water service and sewer service, and shall maintain the facilities. The city may, in the discretion of the city commission, enter into contracts with private individuals for the extension or modification of the facilities of either the water service or the sewer service; but all facilities located or to be located in or upon publicly owned property shall belong to the city and shall be maintained by the city.
