§ 86-147. Alteration of speed limits.

  • (a)

    In accordance with section 86-146 and F.S. § 316.189, the maximum speed limits in this city shall be 30 miles per hour, upon all city streets, and ten miles per hour on all city alleys, except that certain speed zones altering the speed limit may be established by the city after investigation determines such a change is reasonable and in conformity to criteria promulgated by the department of transportation, except that it shall not be necessary to conduct a separate investigation for each residence district. The speed zones with altered speed limits are listed in this schedule:

    (b)

    It is hereby determined upon the basis of an engineering and traffic investigation, in conformity to criteria promulgated by the department of transportation, or by means of engineering judgment as permitted by F.S. § 316.189, that the maximum speed permitted by section 86-146 is greater than is reasonable or safe under the conditions found to exist upon certain streets or parts thereof, and it is hereby declared that the speed limits shall be as set forth in this section on those streets or parts of streets designated in this section, when signs are erected giving notice thereof. Based upon F.S. § 316.189, it shall not be necessary to conduct a separate investigation for each residence district to alter the speed limit. The residence districts that have been investigated (West Palm Beach Speed Study, April 2002) are listed in this schedule and indicated by an asterisk (*). These may be used to establish altered speed zones within comparable residence districts. The streets within residence districts that are determined by the city transportation planner to be comparable to the investigated streets within residence districts shall be signed accordingly by the engineering services division, and it shall be unlawful for any person to drive a vehicle at a speed in excess of any speed so declared when signs are in place giving notice thereof.
