§ 86-96. Notice of impoundment sale to owner and record lienholders; public sale; certificate of sale.

  • (a)

    If the owner of the motor vehicle impounded does not request an impoundment hearing and does not secure release of the motor vehicle by the end of the tenth day after impoundment, a notice of impoundment sale shall be mailed by the city to the owner and to all persons holding a lien of record against the moor vehicle according to the public records. The notice shall:

    (1)

    Describe and identify the motor vehicle land place of impoundment.

    (2)

    State that the motor vehicle shall be sold by the city at public sale to satisfy the city's lien against the vehicle established pursuant to this Code.

    (3)

    State the time, date and place of the public sale.

    (4)

    Specify the amount of the city's lien and the minimum bid necessary to purchase the motor vehicle which shall be the amount of the city's lien computed as of the date of sale.

    (b)

    The sale shall take place not less than ten days from the date of mailing the notice. Not less than ten days prior to the date of sale, a notice shall be published in a newspaper of general circulation within the city.

    (c)

    The city shall not guarantee title to the motor vehicle or deliver a title of ownership but shall furnish the purchaser a certificate in substantially the following form:

    This form shall be in duplicate. The original hall be given to the purchaser and the duplicate bound in a book of record.
