§ 78-497. Parklet standards and criteria.

  • (a)

    General standards. Parklets shall conform to each of the following general standards:

    (1)

    Shall be well designed in conformance with the design standards, attractive, comfortable, and inviting, as determined by the city.

    (2)

    Parklets shall be open to the public. The parklet shall be operated for the purpose of accommodating the public in general without charge along with the patrons of the permittee and may include providing open air dining and beverage service opportunities; provided, however, that nothing in this provision shall be construed as prohibiting the permittee from charging for the sale or service of food or beverage within the parklet. The parklet shall be available to the public at large and not designated primarily for patrons of the permittee.

    (3)

    Shall be maintained in a clean, sanitary and safe manner at all times; free of debris, grime, and graffiti.

    (4)

    All removable tables and chairs must be removed and stored at the close of business. If the parklet is not associated with an adjoining business, all fixtures must be permanently attached to the parklet.

    (5)

    Shall be located in such a manner that a distance of not less than 54 inches is maintained at all times as a clear and unobstructed pedestrian path along the sidewalk. For the purpose of the minimum clear path; parking meters, traffic signs, benches, trees, light poles and all other similar obstacles shall be considered obstructions.

    (6)

    Only one, two square-foot sign shall be permitted. Sign shall include language identifying the parklet as a public space open to everyone. No advertising or business identification shall be permitted.

    (7)

    No outdoor merchandise shall be allowed in the parklet.

    (8)

    No food preparation, food or beverage storage, refrigeration apparatus, or equipment shall be allowed in the parklet.

    (9)

    No amplified entertainment shall be allowed in the parklet, except as authorized by special events permit.

    (10)

    No electrical or plumbing connections.

    (11)

    Alcohol sales shall require an alcohol license extension. However, an alcoholic beverage establishment shall not be eligible for a parklet permit, with the exception of a brewpub, microbrewery, micro-distillery, or micro-winery; as defined in section 6-1 of this Code.

    (12)

    Shall only provide points of entry along the sidewalk side.

    (13)

    Permittee shall pay all applicable real estate taxes or assessments and shall, upon request, exhibit a receipt for such payments to the city annually.

    (b)

    Design standards. Parklets shall conform to each of the following design standards:

    (1)

    Parklet base.

    a.

    Decking shall be flush with the curb and may not have more than a one-half inch gap (vertical or horizontal) from the curb.

    b.

    Maximum cross slope shall not exceed two percent.

    c.

    An 18-inch minimum setback from active driveways shall be provided.

    d.

    An 18-inch minimum buffer shall be provided between the parklet and the nearest edge of a traveled way.

    e.

    A two foot minimum buffer shall be provided between the parklet and the nearest edge of a parking space.

    f.

    Shall comply with ADA standards.

    g.

    Curbside drainage shall not be impeded; a drainage canal underneath the platform shall be installed when necessary.

    (2)

    Safety elements. See figure XVIII-2.

    a.

    A five-foot long wheel stop shall be installed two feet from either side of the parklet side screens, creating a buffer zone. Two-foot buffer zones may include elements that increase the visibility of the parklet.

    b.

    Two white safe-hit type 2 surface mount delineators shall be installed in line with wheel stops, seven feet from the curb edge.

    c.

    Wind resistance, the parklet shall either be wind resistant or a removal plan must be included with the application. The removal plan shall designate two persons responsible for the removal, a list and location of the necessary tools for removal, and a storage location for the parklet.

    (3)

    Parklet screen shall be designed to protect users from surrounding vehicles while maintaining visual appeal.

    a.

    Shall increase the visibility of the parklet.

    b.

    Shall be a minimum width of six inches wide.

    c.

    Shall maintain a visual connection to its surroundings.

    d.

    Shall provide a side buffer of at least 24 inches in height, but no more than 48 inches high.

    e.

    Shall provide an outer buffer of at least 36 inches in height, but no more than 48 inches high.

    f.

    Shall provide fixed landscape and seating elements.

    (4)

    Parklet fixtures.

    a.

    Shall not be placed outside or hang over the designated parklet area.

    b.

    Shall not be physically attached, chained or in any manner affixed to any structure, tree, signpost, or light pole.

    c.

    Shall be commercial-grade furniture.

    d.

    Shall be maintained in a clean, sanitary and safe manner.

    e.

    Shall maintain a minimum vertical clearance of seven feet.
