§ 78-494. Location approval process.

(a)

Location selection. Applications that are otherwise complete shall be reviewed for suitability of the requested location based on the requirements of this article. Any application for a location not meeting all of the requirements of this article shall not be considered.

(b)

[Applications.] If only one acceptable application is received for a specific block face, and it meets all location requirements of this article, the application will be granted location approval and will proceed to the parklet permit review process. If more than one acceptable application is received for a specific block face, a lottery drawing will be held to select one application to proceed to parklet permit review. The applicants of the applications involved in the lottery process shall be noticed in writing of the lottery date, time and place and shall be entitled to attend the lottery drawing.
