§ 78-485. Appeals.
(a)
The permittee, contractor, individual or entity, personally or through their agent or representative, shall have the right to appeal a stop work order and/or assessment of charges and expenses made under this article. All appeals shall be made to a special magistrate in accordance with the procedures set forth in chapter 26, article II of this Code.
(b)
Appeals shall be initiated within ten calendar days of the effective date of the stop work order, revocation of permit or posting of a notice of violation, by filing a written notice of appeal with the office of the city attorney.
(c)
The appeal shall be placed on the next regularly scheduled code enforcement hearing agenda to allow the violator to show cause why the violator should not be responsible for compliance with the provisions of this article.
(d)
Appeals form the decision of the special magistrate shall be made to a court of competent jurisdiction by a petition for writ of certiorari.
