§ 78-438. Exemptions; emergencies.
(a)
The requirements of this article shall not apply to the temporary obstruction of a city public right-of-way by a utility or government agency due to an emergency. "Emergency" includes any condition that threatens the health, safety, and welfare of the public, including an out-of-service condition of a pre-existing utility service. If such an emergency exists, the utility or the governmental entity shall be exempt from the pre-permit application requirements, but shall apply for a permit within 48 hours of the emergency situation.
(b)
The requirements of this article shall not apply to newsracks, sidewalk cafes, and public telephones, each of which shall be subject to all other applicable code provisions and requirements.
