§ 78-421. Generally; definitions.

  • (a)

    The guidelines contained in section 78-422 shall apply to all applications for air rights easements, including column easements, footer easements, and aerial facade easements (collectively the "air rights easements") over public rights-of-way in the downtown master plan area, for the purpose of constructing arcades and cross block connections at the first story level and other space to be constructed above the first story.

    (b)

    As the terms are used in this article:

    CPTED principles means those principles of lighting and landscaping design with the objective of crime prevention.

    Downtown master plan area means the area defined on the regulating plan for the downtown master plan.

    Residential incentive program means the limited duration residential incentive program described in section 94-111, derived from Ordinance No. 3431-01, which is on file with the city and adopted by the city commission on May 14, 2001.

    Sidewalk cafe ordinance means article X of this chapter, derived from Ordinance No. 3293-00, as amended from time to time.
