§ 78-241. Findings and purpose.

  • It is the purpose of newsrack regulations in this article to:

    (1)

    Provide for pedestrian and driving safety and convenience;

    (2)

    Restrict unreasonable interference with the flow of pedestrian and vehicular traffic, including ingress into or egress from any residence or place of business, or from the street to the sidewalk by persons existing or entering parked or standing vehicles;

    (3)

    Provide for the safety of the public and property during windstorms, hurricanes and other inclement weather;

    (4)

    Provide reasonable access for the use and maintenance of poles, posts, traffic signs or signals, hydrants, mailboxes and access to locations used for public transportation purposes;

    (5)

    Relocate and/or replace individual newsracks that have created visual blight on the public rights-of-way or unreasonably detracted from the aesthetics of adjacent businesses, landscaping and other improvements;

    (6)

    Remove abandoned newsracks;

    (7)

    Maintain and protect the value of surrounding properties;

    (8)

    Reduce unnecessary exposure of the public to personal injury or property damage;

    (9)

    Treat all newspapers equally regardless of their size, content, circulation, or frequency of publication;

    (10)

    Ensure a diversity of viewpoints consistent with the First Amendment to the United States Constitution, and to treat all newspapers and other lawful publications equally, regardless of their content;

    (11)

    Maintain and preserve freedom of the press; and

    (12)

    Cooperate to the maximum with newspaper distributors.
