§ 78-92. Street rights-of-way construction.

  • All street rights-of-way within the city shall be constructed in compliance with requirements of the city's engineering services department.

    (a)

    User fee schedule. The city commission shall, by resolution, establish, from time to time, a fee schedule to fund the various functions and services of the engineering services department. A fee shall be paid in accordance with the schedule established by the commission for applications, permits, reviews, record searches, legal recordings, service availability searches, bond administration, legal advertisements, and other administrative services of the engineering services department.

    (b)

    Violations and failure to obtain a permit. For all work commenced prior to the issuance of a permit or commenced without notice as may be required by the engineering services director, the permit fee shall be two times the fee set forth in the user fee schedule or the specific amount delineated therein for violations.

    (c)

    Posting of schedule; nonrefundable fee. The user fee schedule, as amended from time to time, shall be posted in the engineering services department. All applications and permits, as the case may be, shall be accompanied by the required fee. Any application not accompanied by payment of the required fee shall be deemed incomplete and shall not be processed. All fees shall be non-refundable, unless otherwise provided for in the fee resolution, and shall be payable to the City of West Palm Beach upon request for services, submission of an application or issuance of a permit, as determined by the engineering services director.

    (d)

    Applications. The engineering services director shall, as the director deems necessary and from time to time, promulgate application forms and procedures for any review, inspection and permit procedures.
