§ 78-3. Moving trees through streets, etc.

Latest version.
  • It shall be unlawful for any person to move or transport any tree across or along any street or other public way or place of the city or to uproot any tree with the intent to transport the tree without first having obtained a permit from the mayor, which permit shall state the time within which and the places from and to which such trees shall be moved, and shall contain such other requirements as the mayor may deem necessary for the safeguarding of traffic during the moving of such trees; provided that this section shall not apply to trees small enough to be loaded upon an ordinary wagon or motor truck without projecting over the ends or sides of such wagon or motor truck. In prosecuting any violation of this section, it shall not be necessary to negate this exception in the complaint or affidavit charging such offense, but the defendant may establish such exception by evidence as a defense to such a prosecution.
