§ 6-8. Extended hours permit requirements.
(a)
Each alcoholic beverage establishment or a bona fide restaurant holding an extended hours permit shall comply with each of the following permit requirements at all times:
(1)
Security. On Friday and Saturday nights, the establishment shall and provide interior security personnel of a number equaling one security person per each occupancy level of 150 occupants or any portion thereof. For example, if the occupancy level of an establishment is 500, four interior security personnel are required. If the occupancy level is 150, one interior security personnel is required. All persons acting as security personnel shall be required to obtain a security officer ID card from the City of West Palm Beach Police Department, and shall be required to wear such ID card at all times when acting as interior security. Additionally, all establishments shall maintain a log showing the security personnel working each night. This list shall be made available to any law enforcement officer upon request to confirm the number of security personnel staffed.
(2)
Responsible beverage service program . All permit holders and owners, managers, servicing staff, and bar tenders of extended hours permit holders must complete a responsible beverage service program including training in server liability laws. The standards and curriculum of alcohol server education courses shall include but not be limited to the following:
(i)
Alcohol as a drug and its effects on the body and behavior, especially driving ability.
(ii)
Effects of alcohol in combination with commonly used legal, prescription or nonprescription, drugs and illegal drugs.
(iii)
Recognizing the problem drinker and community treatment programs and agencies.
(iv)
State alcohol beverage laws such as prohibition of sale to minors and sale to intoxicated persons, sale for on-premises or off-premises consumption, hours of operation and penalties for violation of the laws.
(v)
Drunk driving laws and liquor liability statutes.
(vi)
Intervention with the problem customer including ways to cut off service, ways to deal with the belligerent customer and alternative means of transportation to get the customer safely home.
(vii)
Advertising and marketing for safe and responsible drinking patterns and standard operating procedures for dealing with customers.
(3)
Maintain premises . All holders of extended hours permits shall maintain their premises and any accessory premises, such as parking lots or open space or sidewalks adjacent to such premises, clean and free from trash and debris.
(b)
Chronic nuisance service order . If a chronic nuisance service order, pursuant to chapter 54, article XIII, has been issued and remains effective against the property upon which the establishment is located, no extended hours permit may be issued to such establishment and any issued permit may be revoked.
(c)
Verified police incidents . An alcoholic beverage establishment shall not have three or more verified police incidents within any 30-day period. Verified police incident shall mean law enforcement activity on the alcoholic establishment's property during the extended hours of operation, either inside or outside the permitted location, that is directly related to either activity of inactivity by the establishment or its staff, with special emphasis on failure to maintain order, illegal activity by any employee, or others associated with the establishment, including allowing underage drinking, violation of open container laws, and loitering by intoxicated individuals. Excessive noise violations shall not be counted toward verified police incidents.
