§ 6-7. Extended hours permit; downtown.
(a)
Privilege. The ability to remain open and sell alcoholic beverages beyond the hour of 12:00 midnight in the downtown master plan area is hereby declared to be and is a privilege subject to suspension, and no person may reasonably rely on a continuation of that privilege. Extended hours licenses are regulatory in nature and revocable in accordance with this chapter.
(b)
Extended hours permit application. Any alcoholic beverage establishment or bona fide restaurant, located within the downtown master plan area holding a license duly granted by the state to sell and dispense alcoholic beverages for on-premises consumption may apply to the city for an extended hours permit. Establishments shall meet all permit requirements at all times during the permit period. Extended hours permits shall be renewed annually. The fee for the issuance of the extended hours permit shall be set by resolution of the city commission, and shall be paid prior to issuance of the permit and prior to annual renewal of an extended hours permit. Permit requirements are established in section 6-8.
(c)
Renewal. Each extended hours permit shall be renewed annually at the same time as payment of the establishment's business tax, upon payment of the applicable fee and a finding by the city that the applicant complies with each permit requirement.
(d)
Extended hours. An extended hours permit granted to a duly licensed alcoholic beverage establishment within the downtown master plan area shall permit and extend the hours in which such establishment may remain open for sale, service of and consumption of alcoholic beverages on the premises until 3:00 a.m. the following morning, Monday through Friday, and until 4:00 a.m. on the following Saturday and Sunday mornings.
(e)
Transferability. Extended hours permits are not transferable to another person or entity. A change in business name alone shall not be considered a new entity.
(f)
Exemption. Extended hours permits are not required for bona fide entertainment establishments.
