§ 6-5. Persons under 21 years of age prohibited.
(a)
It shall be unlawful for persons under the age of 21 to enter, patronize, visit, be admitted to, or allowed access in any alcoholic beverage establishment, except as hereinafter provided. This restriction shall not apply to:
(1)
Persons accompanied by either of their parents (natural, adoptive, or stepparent) or legal guardian (appointed by a court);
(2)
A bona fide restaurant. In the case of hotels and other similar multi-use establishments, this restriction applies only to those areas of the establishment operating primarily as an alcoholic beverage establishment, and not as a bona fide restaurant;
(3)
An alcoholic beverage establishment, during any time period in which it is not serving or selling alcoholic beverages to the public or allowing alcohol to be consumed on its premises; provided that one hour before anyone under the age of 21 is admitted into the establishment, all alcoholic beverages previously served to customers, or being consumed by customers, are removed from customer access and otherwise discarded, and the establishment's entire inventory of alcoholic beverages is properly secured from public access. Securing alcoholic beverages from public access includes locking beer taps and securing or removing all open bottles in the bar area. The bar is required to be inspected by a law enforcement officer to ensure compliance prior to opening for persons under age 21. The sale, service or consumption of alcoholic beverages may not resume until all persons under the age of 21 have vacated the premises;
(4)
Members of the military or armed services with proper military identification to show that they are currently on active duty with a branch of the United States military;
(5)
Persons employed by or at the alcoholic beverage establishments;
(6)
Concerts which are performed at concert venues.
(b)
All persons who own or operate a business establishment, alcoholic beverage establishment, bakery, café, coffee shop, bona fide entertainment establishment, bona fide restaurant, bottle club, cocktail bar, concert venue, establishment with alcohol as accessory use, hotel bar, nightclub, package store or restaurant bar in the city which sells or dispenses alcoholic beverages for consumption on or off the premises shall conspicuously post a notice within said business establishment in such a place where alcoholic beverages are either displayed, purchased or consumed. Such notice shall comply with the requirements of this section. Failure to post such required notice pursuant to the requirements of this section shall constitute a violation of this ordinance. This restriction shall not apply to:
(1)
A bona fide restaurant without a restaurant bar. Such places of business shall conspicuously post a notice within said business establishment in such a place where it will be visible to all employees of said business.
(c)
Required notice shall consist of one or more signs or notices, each of which is not less than ninety-three square inches (8½ inches" × 11 inches), with at least 30-point type, which contains the following information:
(1)
It is unlawful to purchase alcohol if you are under 21 years of age.
(2)
It is unlawful to sell or dispense alcohol to persons under 21 years of age, unless exempt pursuant to F.S. §§ 562.11 or 562.13.
(3)
The penalties associated with the sale or dispensing of alcoholic beverages to persons under 21 years of age include imprisonment in county jail for a period of up to 60 days, a fine up to $500, or both.
(4)
A telephone number to report those who are in violation of the law. Such telephone numbers may include but are not limited to:
