§ 66-232. General program provisions.
(a)
Bidders or proposers will receive credit for small business participation attainment only for subcontractors who are certified in the specific commodity or area of expertise for which credit is sought at the time of bid or proposal opening.
(b)
In the case of a certified small business submitting a bid as a prime contractor, the small business is credited with meeting the percentage of the small business goal that the small business will perform with its own forces plus the percentage of subcontracts awarded to other certified small businesses.
(c)
A single purpose joint venture or partnership, functioning as a prime contractor, and consisting of a small business, where the small business owns and controls at least 51 percent of the entity, and a non-small business, will be credited with small business participation on the basis of percentage of ownership, participation in the work, risk and profit by the small business.
(d)
The successful bidder or proposer shall provide all such forms and information, as appropriate, to demonstrate compliance with this article.
(e)
If a bidder or proposer lists a small business who has been decertified or whose certification expires after submission of bids, the proposer shall, within a reasonable timeframe, secure a substitute small business to attain the small business goal.
(e)
A small business shall notify the city's small business division, and any city prime contractor, within 30 days of any change in ownership interest and/or control.
