§ 58-138. Powers and limitations.
(a)
Powers and duties generally. The golf commission shall have the power to:
(1)
Adopt rules and procedures for the conduct of its meetings which shall be open to the public and governed by the provisions of F.S. ch. 286.
(2)
Operate, manage and maintain the facilities of the West Palm Beach Municipal Golf Course or to enter into, arrangements with others for such maintenance pursuant to contract, lease or otherwise.
(3)
Adopt and enforce rules and regulations for the use, operation, management and maintenance of the West Palm Beach Municipal Golf Course. Such rules and regulations shall prohibit discriminatory practices, excepting the established fee schedules, between annual cardholding members and city resident nonmembers which would favor the annual cardholding members accessibility to facilities of the West Palm Beach Municipal Golf Course.
(4)
Adopt and enforce rules and regulations for the issuance of annual memberships to the West Palm Beach Municipal Golf Course.
(5)
Establish, charge and collect fees for annual memberships and admission to or use of any of the facilities associated with the West Palm Beach Municipal Golf Course and to apply such fees to the operation, maintenance, improvement or enlargement of the West Palm Beach Municipal Golf Course.
(6)
Hire all personnel or operators deemed necessary and proper for the operation, management and maintenance of the facilities connected with the golf commission, and may discharge any person or operator so employed.
(7)
Sue and be sued.
(8)
Contract and be contracted with.
(9)
Have a corporate seal.
(10)
Prepare and provide to the city all financial records and information necessary for an annual audit in accordance with F.S. ch. 218. The fiscal year shall be from October 1 of one year through September 30 of the next year.
(11)
Adhere to the reporting, auditing, filing and other requirements of F.S. ch. 189 and other related laws. Any reports or information, required by law to be filed with the city shall be filed with the city clerk for presentation to the governing body of the city.
(b)
Limitations and restrictions. The powers of the golf commission shall exclude the issuance of bonds, secured by ad valorem taxes or by pledge of both such taxes and other revenues of the golf commission and the issuance of revenue bonds payable solely from the revenues to be derived from the operation, management and maintenance of the West Palm Beach Municipal Golf Course, without the approval of the city commission and the approval of voters in a referendum when required by law.
