§ 58-88. Enforcement.

  • (a)

    Generally. It shall be unlawful for any person to do any act forbidden or fail to perform any act required by this chapter, or for any person to fail to comply with any lawful and reasonable order given by law enforcement officers or authorized department officials.

    (b)

    Ejectment. The director of parks and recreation, park attendant, parks and recreation department personnel or any law enforcement officer of the city shall have the authority to eject from a park any person acting in violation of this article and is an authorized person pursuant to 810.09, Florida Statutes to ask an owner, operator or occupant of a boat in violation of section 58-84(b)(4) of this chapter to leave city property.

    (1)

    City docks. If any law enforcement officer of the city observes a violation of section 58-84(b)(4) of this chapter, the officer will ask the owner, operator or occupants to leave city property immediately. If the owner, operator or occupants fail to leave, the officer may subject each of the operator or occupants to the following, as applicable:

    a)

    A fine not exceeding $500.00 or imprisonment for a definite term not exceeding 60 days, or both, pursuant to section 1.13 of this Code; and

    b)

    All prescribed procedures and penalties in F.S. § 810.09; and

    c)

    Have the boat removed at the owner's expense.

    Any property with no discernable owner will be treated as lost or abandoned. The above remedies are not intended to limit any other procedures or remedies available in this Code or at law.
