§ 54-85. Responsibilities of property owners; notices.

  • (a)

    It shall be the responsibility and the duty of any person who is the owner or who has primary responsibility for control, repair, or maintenance of property within the city to remove graffiti on such property within the ten days after service of notice of the defacement.

    (b)

    The notice of the existence of graffiti shall contain the following information:

    (1)

    The name of the property owner;

    (2)

    The street address and legal description of the property sufficient for identification of the property;

    (3)

    A statement that the property is a potential graffiti nuisance property with a concise description of the conditions leading to the finding; and

    (4)

    A statement that the graffiti must be removed within ten days after receipt of the notice and that if the graffiti is not abated within the time, the city will declare the property to be a public nuisance, subject to the abatement procedures in section 54-87.

    (c)

    The notices required by this section shall be served as set forth in section 26-36.
