§ 46-32. Alarm permit required.
(a)
No person shall have an alarm system installed, monitored and/or activated, or use an existing alarm serving any premises, or a building, or portion thereof, occupied or controlled by such person, unless an alarm permit in the form of a decal has been issued under this article and is in force, authorizing the use of such alarm system. Violation of this section shall result in a civil penalty to the nonmonitored alarm user or alarm company in the amount established by resolution of the city commission and cancellation of any further police response to such location. Such alarm permit shall constitute a regulatory license. Such decal shall be displayed in a conspicuous place visible to the outside of the premises covered by such registration.
(b)
If a business has one or more alarm systems protecting two or more separate structures having different addresses, a separate permit will be required for each structure. Violation of this section shall result in a civil penalty in the amount established by resolution of the city commission.
(c)
If an apartment complex provides alarm systems in each residential unit of the complex, then the owner shall obtain an alarm permit for each apartment. All units, whether occupied or not, which have alarm systems shall be required to have separate alarm permits. Each apartment shall be considered a separate alarm user.
(d)
All persons, firms, organizations, and alarm companies that install monitor, repair, or activate an alarm system in the city must be licensed according to state, county and city requirements. These persons, firms, alarm companies, and organizations, when performing the installation, repair, monitoring or activation of an alarm system, must instruct the user of the alarm system in its use and function at the time of installation, repair or activation.
(e)
An alarm user registration decal shall be mailed to the alarm user by the city at the address of the alarm user stated on the application within 20 days after receipt of such completed application by the police department.
(f)
An alarm user permit shall be denied if:
(1)
The requested information is not supplied in the application, as set forth in section 46-33.
(2)
Material information on the application is incorrect.
(3)
Any person or entity listed on the application under section 46-33(b)(4)—(6) does not possess any required occupational or regulatory license to conduct the activities required by section 46-33(b)(4)—(6), unless the person or entity is the alarm user;
(4)
Any outstanding false alarm charges have not been satisfied.
