§ 38-54. Smoking in theaters and other places when prohibited by the fire chief.

  • (a)

    It shall be unlawful for any person to smoke any cigar, pipe or cigarette or to smoke or to burn tobacco in any form in any theater, motion picture theater or any other place in the city where signs containing the words "No Smoking" have been posted pursuant to any order of the fire chief.

    (b)

    The fire chief shall order such signs erected in any place of public assemblage in the city wherein, in his/her opinion, smoking would constitute a menace to life or property; provided that this section shall not be construed so as to make it unlawful for a performer to smoke in smoking areas designated as such which have been approved by the fire chief.
