§ 38-36. Scheduling of inspections.
(a)
Annual inspections shall be conducted for any structures or buildings whose occupancy type, as defined by state statute and N.F.P.A. standards adopted by the city, is classified as priority 1 for inspection purposes based upon hazard. Such structures or buildings include, but are not limited to, multi-level buildings of three stories or 50 feet or higher, public assemblies with an occupancy of 100 or more persons, food service establishments, educational structures or buildings, child care facilities, transient lodging facilities, apartment buildings containing 12 or more units, residential board and care facilities, self-service gasoline stations, class A mercantiles, high hazard storage or processes, health care facilities, rehabilitation residential facilities, and correctional or detention facilities.
(b)
Inspections shall be conducted bi-annually on structures or buildings whose occupancy type, as defined by state statute and by N.F.P.A. standards adopted by the city, is classified as priority 2 for inspection purposes based upon hazard. Such structures include, but are not limited to, apartment buildings with less than 12 units, class B and C mercantiles, public assemblies, other than food service establishments, with an occupancy of less than 100 persons, light industry businesses without hazardous processes or contents, storage facilities, and business offices.
(c)
Nothing in this section shall be construed to prohibit the entry of the fire rescue department into any structure or building at any time for the purpose of conducting an inspection of fire code violations as necessary, required by this code, or for reasonable cause as authorized by F.S. § 633.081.
