§ 26-2. Failure to correct violation; hearing before special magistrate.

  • (a)

    Hearing before special magistrate. The special magistrate shall review the record or evidence constituting a violation of this Code. The property owner shall have an opportunity to present evidence in his or her defense. All testimony shall be under oath and shall be recorded.

    (b)

    Order of the special magistrate. At the conclusion of the hearing, the special magistrate shall issue findings of fact and conclusions of law. If the special magistrate determines that a violation of this Code continues to exist upon real property, the special magistrate shall order the property owner to correct the violation or authorize the city to correct the violation. The decision of the special magistrate shall be in writing and shall be deemed final.

    (c)

    Compliance with order of the special magistrate. If the violation is not corrected within the time ordered by the special magistrate, the city may thereafter impose monthly reinspection assessments in accordance with this article until the violation is corrected. If the violation is corrected within the time ordered by the special magistrate, no reinspection assessment shall be imposed.
