§ 22-433. Penalty for violation.

  • (a)

    The special magistrate upon, determination by the city that a secondary metals recycler, junk merchant, or junk peddler is in violation of the provisions of this article, shall have power and authority to suspend or revoke any certificate of use issued under this article for any violation of a licensed secondary metals recycler, junk merchant, or junk peddler of any of the provisions or conditions contained in this article.

    (b)

    The city shall notify, in writing, the secondary metals recycler, junk merchant, or junk peddler of the grounds for such violation and provide such secondary metals recycler, junk merchant, or junk peddler notice of hearing before the special magistrate; provided such certificate of use shall be revoked only after the licensee shall have been notified in writing at his place of business of the violations complained of and shall have been afforded a reasonable opportunity to have a hearing thereon before the special magistrate. Procedure for notice and hearing shall be prescribed in chapter 26, article II of this Code.
