§ 22-417. Penalty for violation.

  • (a)

    The special magistrate, upon determination by the city that a secondhand goods dealer is in violation of the provisions of this article, shall have power and authority to suspend or revoke any certificate of use issued under this article for any violation of a licensed secondhand goods dealer of any of the provisions or conditions contained in this article.

    (b)

    The city shall notify, in writing, the secondhand goods dealer of the grounds for such violation and provide such secondhand goods dealer notice of hearing before the special magistrate pursuant to sections 26-33 and 26-36 of this Code; provided such certificate of use shall be revoked only after the licensee shall have been notified in writing at his place of business of the violations complained of and shall have been afforded a reasonable opportunity to have a hearing thereon before the special magistrate. Procedure for such hearings shall be prescribed in chapter 26, article II of this Code.
