Article X. SECONDHAND GOODS DEALERS |
§ 22-413. Recordkeeping requirements.
(a)
Each secondhand goods dealer shall legibly, in the English language, complete a transaction form at the time of each transaction. Unless other arrangements have been agreed upon by the secondhand goods dealer and the city police department, the secondhand goods dealer shall, within 24 hours after the acquisition of any secondhand goods, deliver to the city police department a record of the transaction on a form approved by the city. Such record shall contain:
(1)
The time, date, and place of the transaction.
(2)
A complete and accurate description of the goods acquired, including the following information, if applicable:
a.
Brand name.
b.
Model number.
c.
Manufacturer's serial number.
d.
Size.
e.
Color, as apparent to the untrained eye.
f.
Precious metal type, weight, and content if known.
g.
Gemstone description, including the number of stones, if applicable.
h.
In the case of firearms, the type of action, caliber or gauge, number of barrels, barrel length, and finish.
i.
Any other unique identifying marks, numbers, or letters.
(3)
A description of the person from whom the goods were acquired, including:
a.
Full name, current residential address, workplace, and home and work phone numbers.
b.
Driver's license, or personal identification card.
c.
Height, weight, date of birth, race, gender, hair color, eye color, and any other identifying marks.
d.
The right thumbprint, free of smudges and smears, of the person from whom the goods were acquired. If the right thumbprint cannot be obtained, the left thumbprint shall be obtained and the reason why the right thumb print was not available shall be listed on the form.

The person handling the transaction.
(b)
The requirement that the seller be thumb-printed shall not apply to any purchase or trade-in transaction which occurs at an auction or in the private house or office of the person selling said items, but all other requirements as aforesaid shall remain in effect.
(c)
No secondhand goods dealer shall accept any article or property as full or part payment, or purchase any article or property unless it has verified the identification, by the exhibition of a photographic personal identification card of the person from whom such article is being received.
(d)
All secondhand goods dealers regulated by this article shall maintain each and every completed transaction form on the registered premises for three years from the date of the transaction. No secondhand goods dealer shall refuse to deliver such transaction form to any law enforcement officer upon request in connection with a specific item of stolen property within three years following the date of the transaction.
(e)
Every secondhand goods dealer shall display a notice to his customers in a prominent place to the effect that it is required to fingerprint every person selling or offering as full or part payment an item.
(f)
At least 60 days prior to the destruction of a transaction form, the secondhand goods dealer shall notify, in writing, the city police department of his intent to destroy such documents. The city police department, at its option, shall request the secondhand goods dealer to turn over all said documents to the city police department.
