§ 22-408. Application for certificate of use.

  • (a)

    Before the city shall be required to issue a certificate of use to engage in, or carry on the business of a secondhand goods dealer, it shall be the duty of the owner/applicant to file an application with the city pursuant to chapter 22, article II of this Code.

    (b)

    The following provisions shall also apply to the application:

    (1)

    If the applicant is a partnership, all the partners must apply.

    (2)

    If the applicant is a joint venture, association, or other non-corporate entity, all members of such joint venture, association, or other non-corporate entity must make application for registration as natural persons.

    (3)

    If the applicant is a corporation, the registration must include the name and address of such corporation's registered agent for service of process in the state and a certified copy of statement from the Florida Department of State that the corporation is duly organized in the state or, if the corporation is organized in a state other than Florida, a certified copy of statement from the Florida Department of State that the corporation is duly qualified to do business in this state. If the dealer has more than one location, each location owned by the same legal entity must separately apply for a certificate of use.

    (4)

    The secondhand goods dealer shall furnish with their registration a complete set of his/her fingerprints, certified by an authorized law enforcement officer, and a recent full face photographic identification card of himself or herself to the city police department for purposes of performing a criminal background check. The city police department shall report its findings to the applicant within 30 days after the date fingerprint cards are submitted for criminal background information.

    (c)

    Before a certificate of use shall be issued to a secondhand goods dealer, the city shall procure from the city police department, an approval on the back of the application stating:

    (1)

    That the applicant is a natural person who has reached the age of 18 years, or an entity qualified to do business in the state.

    (2)

    That in their opinion the applicant has a good moral character and shall not have been convicted within the ten years preceding the date of application for license or for renewal of license or be on parole or a fugitive from justice for any federal, state or municipal offense involving:

    a.

    Drugs or narcotics;

    b.

    Robbery;

    c.

    Burglary;

    d.

    Auto theft;

    e.

    Stealing;

    f.

    Receiving stolen property;

    g.

    Embezzlement;

    h.

    Extortion;

    i.

    Forgery;

    j.

    Gambling;

    k.

    Bribery;

    l.

    Perjury;

    m.

    Any weapons offense; or

    n.

    Any crime of violence.

    (d)

    The secondhand goods dealer's certificate of use shall be conspicuously displayed at the secondhand goods dealer's registered location.
