§ 22-253. Use of streets and sidewalks; special event restrictions.

  • (a)

    No peddler shall:

    (1)

    Conduct business in any zone where the stopping, standing or parking of a vehicle is prohibited by chapter 86, article IV of this Code;

    (2)

    Conduct business in such a manner that unreasonably obstructs or interferes with pedestrian or motor vehicle traffic flow or circulation areas;

    (3)

    Operate in any manner that constitutes a public nuisance;

    (4)

    Operate in violation of the city's noise control regulations, as required by chapter 34, article II of this Code, and all other city ordinances;

    (5)

    Distribute handbills or other solicitations to advertise the peddler's business or other businesses;

    (6)

    Conduct business without providing a waste container or receptacle for the deposit of food scraps, food wrappings, cups, napkins and other refuse generated by customers of the peddler;

    (7)

    Discharge any liquid or solid wastes from the peddler's vending unit, pushcart, trailer, truck or vehicle onto the streets and sidewalks, or into sewers and drainage systems;

    (8)

    Place any items relating to the operation of the peddler's business upon any public right-of-way adjacent to the peddler's vending unit, pushcart, trailer, truck or vehicle;

    (9)

    Conduct business on private property without having first obtained the signed and notarized written permission of the property owner;

    (10)

    Conduct business on private property in any parking space(s) counted as required parking for planning approval purposes;

    (11)

    Park or store a peddler's vending unit, pushcart, trailer, truck or vehicle, or any items relating to the operation of the peddler's business, overnight on private property within the reasonable view of persons using the public streets or sidewalks.

    (b)

    Downtown area. No peddler shall conduct business or engage in the activities set forth in the definition of "peddler" in section 22-251 on public streets, sidewalks or other public property in the downtown area as defined in section 22-251, except as otherwise provided in this section.

    (1)

    This subsection shall not apply to: peddlers at the Green Market; peddlers acting as concessionaries at a special event with the express written approval of the city or special event organizers/sponsors; or peddlers conducting business pursuant to a franchise or other agreement with the city.

    (c)

    For the purposes of this section the term "special event" shall have the following meaning: any event, exhibition, or promotion held on any city right-of-way or other city property with the express written consent, approval, license, or cooperation of the city. In addition to the requirements and prohibitions concerning use of the public streets by peddlers in this section, all certificates of registration issued to peddlers under the provisions of this Code will not be valid in areas designated as the site of a special event, or on any city right-of-way or city-owned property for two blocks in all directions from the outside perimeter boundary of the designated site of a special event, during the hours of operation set by the city for each special event.
