§ 22-221. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the following meanings:

    Compensation means a return in money, property, or anything of value for the rendition of vehicle for hire service, including tips.

    Downtown area or downtown means the following districts regulated by chapter 94, article IV, Downtown Master Plan Urban Regulations, as depicted by DMP Zoning Atlas Figure 2, District Boundaries: CityPlace district (CPD) and Clematis waterfront district (CWD).

    Driver means the individual who is driving or physically operating a vehicle for hire.

    Limousine means a chauffeur-driven motor vehicle for hire, not equipped with a taximeter or top light, where passenger service is prearranged. It may include a stretch vehicle, luxury vehicle, sedan or van, and jitneys.

    Motorized vehicle for hire means any motorized, self-propelled vehicle engaged in the transportation of persons upon the streets of the city with the intent to receive compensation for providing such transportation including privately paid, contractual or prearranged transportation.

    Non-medical, wheelchair and stretcher transportation service means the transportation of persons while on stretchers or wheelchairs, or persons whose handicap, illness, injury, or other incapacitation makes it impractical to be transported by a regular common carrier such as a bus, taxicab, or other vehicle for hire.

    Owner means any individual, firm, corporation, partnership, company, association, joint venture or other type of organization enterprise or legal entity that owns a vehicle for hire or a vehicle for hire company.

    Passenger means an individual utilizing a vehicle for hire service for the purpose of being transported to a destination. Passenger shall include an individual who is awaiting the arrival of a dispatched vehicle for hire.

    Taxicab means a motorized vehicle for hire that is equipped with a taximeter and that is engaged in the transportation of passengers for compensation where the destination is controlled by the passenger. For the purposes of this article, this shall not include the sole act of delivering any passenger to a location within the city from beyond the boundary limits of the city. This definition does not include limousines, buses or non-motorized vehicles for hire.

    Taxicab stand means a location designated by resolution of the city commission for the use of taxicabs to pick up and discharge passengers.

    Vehicle for hire means any vehicle engaged in the transportation of individuals upon the streets of the city with the intent to receive compensation for providing such transportation. A vehicle for hire includes, but is not limited to, taxicabs, limousines, SUVs, transport vans/shuttles, non-medical wheelchair and stretcher transportation services, and the use of personal vehicles.

    Vehicle for hire company means any corporation, business entity, individual or other legal entity which that operates or contracts with one or more vehicles for hire, provides vehicles or services to drivers of vehicles for hire, or which operates a central dispatch for one or more vehicles for hire. The term shall not be construed to exclude any person or entity owning, controlling, operating or managing any type of motor vehicle used in the business of transportation of persons for compensation.
