§ 22-34. Application for certificate of use existing business.

  • (a)

    On or before August 1 of each year, the city shall send a notice, by regular United States Mail, to the business address, notifying the owner/applicant of the expiration date. The renewal application which includes and conforms to the requirements of subsections 22-33(b) and (c) shall be sent to the owner/applicant at the last address shown on the certificate of use application on file with the city.

    (b)

    The owner/applicant shall have 30 days in which to file the completed application with the accompanying renewal fees.

    (c)

    The city shall have 30 days from the date of receipt of the application to process the application.

    (d)

    If there are deficiencies in the application, the city shall notify the owner/applicant, and the owner/applicant shall have ten days in which to correct the deficiencies and to request the continued processing of the application.

    (e)

    If an owner/applicant does not comply with the terms of this article, the certificate of use shall be denied.

    (f)

    If the city fails to timely process the provisions of this section, the certificate of use shall be deemed granted for the appropriate renewal period. Nothing contained in this section shall prevent the city from seeking a revocation of a certificate of use as provided for in section 22-39.
